Oilcode Review Issues Paper

Department of Industry

The Competition and Consumer (Industry Codes — Oilcode) Regulation 2006 (Oilcode) regulates the conduct of suppliers, distributors and retailers in the petroleum marketing industry. The Department of Industry has a regulatory requirement, resulting from the 2008 review of the code (see section 3 of this paper), to undertake a review of the Oilcode.

This Oilcode review will examine the ongoing need for the Oilcode and the operation of the code to determine if it provides appropriate regulation of the conduct of participants in the petroleum marketing industry, particularly with regard to:

  • the establishment of standard contractual terms and conditions for fuel reselling agreements
  • the usefulness and effectiveness of terminal gate price arrangements
  • the operation of the dispute resolution scheme
